Terms of Service

By downloading, installing, or using NearCrush, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use NearCrush.

We may update these Terms from time to time. Continued use of NearCrush after changes take effect constitutes your acceptance of the updated Terms. These Terms incorporate our Privacy Policy by reference.

You must be at least 18 years old to use NearCrush. By using the app, you represent and warrant that you are at least 18 years of age and have the legal capacity to accept these Terms in your jurisdiction.

NearCrush allows you to optionally set a username, a short description, gender, and a visibility preference. This information is stored only on your device and is never transmitted to our servers.

You are solely responsible for the content you choose to display on your profile. Content must not be:

• Offensive, threatening, or harmful to others
• Illegal or in violation of any applicable law
• Defamatory, obscene, or sexually explicit
• Impersonating another person

NearCrush operates entirely on-device:

• Wi-Fi must be enabled to discover and be discovered by nearby users
• Bluetooth must be enabled to display the distance to nearby users in meters
• All messaging and matching is peer-to-peer — no server is involved
• All data, including messages and match history, remains on your device at all times

You agree to use NearCrush lawfully and respectfully. You must not:

• Impersonate any person or misrepresent your identity
• Harass, threaten, intimidate, or harm other users
• Use the app for any unlawful or fraudulent purpose
• Attempt to reverse-engineer, modify, or interfere with the app
• Collect information about other users without their consent
• Use the app to stalk, exploit, or harm any individual

NearCrush provides in-app tools to block and report other users. You are encouraged to use these features to report abusive behavior.

Premium features are available through Apple's in-app purchase system.

• Payment will be charged to your Apple ID account at the confirmation of purchase.
• Subscription automatically renews unless it is cancelled at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage and cancel your subscriptions by going to your Account Settings on the App Store after purchase.
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

Refunds are subject to Apple's refund policy. NearCrush has no control over billing or refund decisions. Your Premium status is linked to your Apple ID and can be restored across devices using "Restore Purchases".

NearCrush does not maintain server-side accounts. Your profile and all associated data exist only on your device. Deleting the app removes your account and all local data.

A unique device identifier may remain in your device's local storage to support app functionality (e.g., restoring Premium status). This identifier is not linked to any personal information and is not accessible to NearCrush.

NearCrush, its design, features, and content are owned by NearCrush and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the app without our explicit written permission.

You agree to defend, indemnify, and hold harmless NearCrush and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising from or related to: (a) your use of NearCrush; (b) your violation of these Terms; (c) your violation of any rights of another user or third party; or (d) any content you display on your profile.

NEARCRUSH IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEARCRUSH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF NEARCRUSH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

NearCrush reserves the right to discontinue the app or any of its features at any time, with or without notice. Since NearCrush is an on-device application, discontinuation of the service would mean future updates and new features would no longer be available.

You may cease using NearCrush at any time by deleting the app from your device.

NearCrush shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including acts of God, natural disasters, pandemic, war, terrorism, civil unrest, governmental actions, power failures, or internet disruptions.

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and NearCrush regarding your use of the app and supersede all prior agreements.
• Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force.
• No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
• Assignment: You may not assign your rights under these Terms without our prior written consent. NearCrush may assign these Terms without restriction.

These Terms are governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict of law principles.
