Terms of Service

By downloading, installing, or using NearCrush, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use NearCrush.

We may update these Terms from time to time. We will notify you of significant changes at least 30 days in advance. Your continued use of NearCrush after changes take effect constitutes your acceptance of the updated Terms.

You must be at least 18 years old to use NearCrush. By using the service, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations
• You are not prohibited from receiving services under the laws of your jurisdiction

To use NearCrush, you must create an account. You are responsible for:

• Providing accurate, complete, and current information during registration
• Maintaining the security of your account credentials
• All activity that occurs under your account

You may not create multiple accounts, share your account, or transfer it to another person. We reserve the right to suspend or terminate accounts that violate these Terms.

You agree to use NearCrush only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

• Post false, misleading, or fraudulent information
• Harass, bully, intimidate, or threaten other users
• Send unsolicited messages or spam
• Impersonate any person or entity
• Collect or harvest user data without consent
• Use automated tools or bots to access the service
• Interfere with or disrupt the integrity of the service
• Attempt to gain unauthorized access to any portion of the service
• Violate any applicable local, state, national, or international law

You retain ownership of content you post on NearCrush. By posting content, you grant NearCrush a non-exclusive, worldwide, royalty-free license to use, store, display, and distribute that content solely to provide and improve the service.

You are solely responsible for the content you post. Content must not be:

• Illegal, obscene, defamatory, threatening, or invasive of privacy
• Infringing on any intellectual property rights
• Containing viruses or malicious code
• Depicting minors in any sexual or inappropriate context

We reserve the right to remove content that violates these Terms without notice.

Your privacy is important to us. Our Privacy Policy, incorporated into these Terms by reference, describes how we collect, use, and share information about you. By using NearCrush, you agree to our Privacy Policy.

NearCrush and its original content, features, and functionality are owned by NearCrush Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our services or software without our explicit written permission.

NearCrush is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, secure, or error-free.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEARCRUSH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

We may suspend or terminate your account at any time, with or without cause, with or without notice. You may delete your account at any time via the app or by visiting nearcrush.app/delete-account.

Upon termination, your right to use NearCrush immediately ceases. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Any dispute arising from these Terms shall be subject to binding arbitration in San Francisco, California, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.
